2. Role as EU Authorised Representative
Surgerii Robotics (Netherlands) B.V. acts as EU distributor and Authorised Representative, within the meaning of Article 11 of Regulation (EU) 2017/745 on medical devices (the "MDR"), for Beijing Surgerii Robotics Company Limited (abbreviated as SHURUI Robotics) ("Manufacturer"). Details identifying the Manufacturer and the specific devices covered by this mandate are set out in the applicable product documentation and, where required, on the label or instructions for use of the device concerned.
Surgerii Robotics (Netherlands) B.V. performs the tasks required of an authorised representative under Article 11(3) of the MDR pursuant to a written mandate agreed with the Manufacturer, including verifying that the EU declaration of conformity and technical documentation have been drawn up, keeping specified documentation available to competent authorities, complying with applicable registration obligations, and cooperating with competent authorities as required by the MDR.
Acting as an authorised representative does not make Surgerii Robotics (Netherlands) B.V. the manufacturer of the devices described on this Website. Regulatory responsibility for the design, manufacture, conformity assessment, and safety and performance of the devices remains with the Manufacturer, without prejudice to the joint and several liability of the authorised representative for defective devices in the circumstances set out in Article 11(5) of the MDR, where applicable.
